These terms and conditions (“term”), including any revised terms that we may post from time to time, state the terms and conditions under which we provide you with various services on www. besttimetovisitsrilanka.com website (the “site”), owned and operated by Ultimate Sri Lanka private limited on behalf of its affiliates Ultimate Sri Lanka, these terms (which also incorporate our privacy policy) are a legally binding agreement between you and Ultimate Sri Lanka and govern your use of this site as well as all accommodations, transportation, services and activities included in the Resort stays described on our site (“services”).

BY ACCESSING, BROWSING, AND/OR USING OUR SITE AND/OR SERVICES ON THE WEBSITE AND/OR BY MAKING A CONFIRMED RESERVATION ON OUR SITE, YOU ARE DEEMED TO ACCEPT THESE TERMS AND AGREE TO BE BOUND BY THESE TERMS AND BY ALL TERMS, POLICIES AND GUIDELINES INCORPORATED BY REFERENCE, WHILST USING OUR SITE, SERVICES AND DURING YOUR STAY.

We may make changes to these Terms and Conditions from time to time in our sole discretion. Each time changes are made to these Terms, a revised set of Terms will be posted on the reservation page for Ultimate Sri Lanka. Please check them regularly to take notice of any changes. Your continued use of our Site following the posting of changes constitutes your acceptance of any such changes. These Terms and Conditions apply to all transportation, accommodations, packages, services, and activities included in the trips described on our Site. By making a reservation for a trip described in our Site, you accept and agree to these Terms and Conditions as applicable to that trip.

DISCLAIMERS

As a condition of your use of this website, you warrant to Ultimate Sri Lanka that you will not use this website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. although Ultimate Sri Lanka may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on this website, we are under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the website. you are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.

NO SHOW / FAILURE TO CANCEL

Each resort booked through Ultimate Sri Lanka is subject to a cancellation policy. Failure to check in on the reserved arrival date will incur a penalty charge as detailed in the cancellation policy as stated below.

CANCELATION POLICY

We reserve the right to cancel or modify reservations when it appears that a customer has engaged in a fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error. We reserve the right to cancel or amend bookings if they do not adhere to our terms & conditions. If a guest chooses to shorten their stay or check out early a penalty charge will apply, as detailed in the cancellation policy associated with the resort booked.

The cancelation policy would be applicable 21 days prior to the booking date, whereby the client will be charged 50% of the tour cost or the property applicable rate.

14 days prior to arrival would incur a 100% cancelation charge upon the booking or property applicable rate.

LIMITATION OF LIABILITY

Notwithstanding anything contained in these terms and conditions to the contrary, Ultimate Sri Lanka shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arisen out of the performance or nonperformance of obligations under this terms and conditions.

PAYMENT POLICY

50% payment to be made upon confirmation of the tour through Ultimate Sri Lanka with the balance 50% payment due to be paid 22 days prior to arrival. Failure to comply with the payment policy could amount to cancellation of the tour at the discretion of Ultimate Sri Lanka as subject to terms & conditions.
